SENIOR LITIGATION SPECIALIST/CORPORATE REPRESENTATIVE

Utilizes adjusting and litigation experience to handle litigated files and appear and testify on behalf of Frontline with respect to matters handled by Frontline.

Oversee all aspects of file handling on assigned 1st party claims, inclusive of reviewing coverage analysis, investigation, negligence/compensability/damage assessment and subrogation potential as warranted.  Approve and monitor litigation management and settlement negotiations.  Establish and monitor appropriate reserves.   Mentor front line adjusters and assist management as requested.  Ensure files assigned are handled within FL state statutes, Frontline claims handling guidelines and best practices. Other duties include travel related to appearing as the Frontline representative as Corporate Representative at depositions, mediations, court hearings and the Corporate office in Lake Mary, FL.

Essential Duties

  • Demonstrated ability to work effectively, independently and within a collaborative team-oriented environment using sound judgment in decision-making.
  • Demonstrated ability to manage relationships with both internal and external customers.
  • Excellent communication skills both oral and written with strong presentation skills
  • Strong analytical and problem-solving skills. Ability to review lawsuits for potential deficiencies and provide recommendations as to the viability of a negotiated settlement versus continued litigation.
  • Demonstrated proficiency with MS Office products (Outlook, Word, Excel, PowerPoint) and claims related software applications
  • Use technological knowledge of estimating and repair methods to review and compare estimates for overlap, pricing, understanding of proper industry standards and repair options and assess the potential effect on jury views and trial outcomes
  • Audit complex residential and commercial open claim files for accuracy and completeness and to assure company and State required guidelines are followed.
  • Record results of open claims audits and present findings in meetings with Legal Management and Adjusters.
  • Perform analysis, identify trends, and provide recommendations to improve technical and procedural aspects of claims handling.
  • Identify Adjuster coaching opportunities and communicate findings to management.
  • Participate in legal meetings as requested by Claims Managers
  • Assist VP of Legal and Claims QA in identifying training needs and developing and organizing training materials, multimedia visual aids, and other educational materials.
  • When Complex Claims are identified as on track to go to the legal department, take over the adjustment of those claims, including collecting and reviewing all loss related facts, performing an analysis under the terms of the insurance policy to make a coverage recommendation, and issuing a payment with the applicable authority level.
  • Maintain appropriate diary on pending claims.
  • Report all suits, time limit demands, and mediations. Request pre-mediation and pre-trial reports timely from counsel.
  • Maintain knowledge of current industry developments, case law changes and best practices.
  • Forwards files with subrogation potential for collection in a timely manner
  • Makes referrals to SIU as warranted.

The corporate representative (CR) acts as the voice of the corporation and “represents the corporation just as an individual represents himself.” As such, the CR speaks on behalf of the corporation. Therefore, the corporation is bound by the testimony of its corporate representative, because the testimony represents the knowledge of the corporation, not of the individual deponent. As such, the CR may be deposed on areas inclusive of the facts of loss, claim handling, subjective beliefs and opinions contained within the file, use of vendors and experts assigned, coverage decisions made, denials issued, and payments made.

SUPERVISORY RESPONSIBILITIES

This job has no supervisory responsibilities.

QUALIFICATIONS

Individual must have high level of interpersonal skills to handle sensitive and confidential situations.  Position continually requires demonstrated poise, tact and diplomacy.  To perform this job successfully, an individual must be able to perform each essential duty satisfactorily.  The requirements listed below are representative of the knowledge, skill, and/or ability required.

The individual must be able to interact and communicate with individuals at all levels of the organization; and must have knowledge of a variety of computer software applications in word processing, spreadsheets, database and presentation software.

Work requires continual attention to detail in composing, typing and proofing materials, establishing priorities and meeting deadlines.  The individual must be able to work in a fast-paced environment with demonstrated ability to handle multiple tasks and demands.

Must possess, or have the capability to obtain a Florida Adjuster’s license

EDUCATION AND/OR EXPERIENCE

  • 5 Years of Florida first and third- party homeowner claim handling experience
  • 4 Years of litigation experience.
  • 3 Years of liability experience.
  • 3 Years of technical experience with estimating software and repair methodology
  • Bachelor’s degree in Business Administration, an industry related field, and/or equivalent education required.

LANGUAGE SKILLS

Ability to read and comprehend detailed instructions, correspondence, and memos. Ability to professionally execute excellent verbal and written communications. Ability to effectively present information in one-on- one and small group situations to customers, clients, and other employees of the organization.

MATHEMATICAL SKILLS

Ability to add, subtract, multiply, and divide in all units of measure, using whole numbers, common fractions, and decimals. Ability to compute rate, ratio, and percent and to draw and interpret bar graphs.

REASONING ABILITY

Ability to apply common sense understanding to carry out instructions furnished in written, oral, or diagram form. Ability to deal with problems involving several concrete variables in standardized situations.
